Daytona Beach DUI attorney Kevin J. Pitts was interviewed by Loren Korn of WKMG local affiliate to CBS News to discuss the Robert Gilliland case. The interview subject was why Mr. Gilliland was arrested only  for felony aggravated battery on a person over 65 and not for misdemeanor Driving Under the Influence (DUI). Mr. Pitts discussed the requirements for a misdemeanor arrest in general and specifically that  (with a few exceptions) the officer needs to observe each and every element of the misdemeanor  offense to make an arrest without a warrant. Based on the information provided to Mr. Pitts, the opinion is that the officer could not have legally arrested Mr. Gilliland for the misdemeanor Driving Under the Influence charge (DUI).
